Service Agreement

ONLINE DESIGN AGREEMENT:

To retain SRD Studio’s services copy and paste the agreement below into an email and add the requested contact information along with the statement:  “Contract terms and conditions are accepted”.  SRD Studio will contact you with a payment arrangement through our PayPal account and a request for a phone meeting to begin work on your project.

Hereafter referred to as the Client.  The Client agrees and enters into this Services Contract as stipulated by the following.

SECTION A: Services:

Full Services for a Custom Home by a Licensed Builder or Homeowner shall include Design and Drafting.   Design shall include initial consultation and design program resulting in schematic preliminary design documents and revision and refinement of design preliminaries of two iterations.  Thereafter design revision shall be performed at an hourly rate as described in Section B: Cost of Services.  Upon completion of the Design phase the project will be scheduled for production of Construction Documents. (Note:  This contract is not a transfer of intellectual property rights.)

Construction Documents shall include: plan views of floors, exterior elevations, floor and roof framing schematics, section and details, footing and foundation drawings sufficient to attain building permit and as required by building permit authorities excluding Braced Wall Engineering.  Note: Construction Documents shall not include information that falls under the responsibilities of other licensed practices such as land surveyors, engineers, or interior designers except in the most generic form to facilitate design and review by those practices.  Construction documents shall be submitted to the Client for review.  This review shall be completed within a 30 day period time for one set of revisions at no charge for corrections to documents of any errors and/or omissions the Client wants corrected.  All changes to the Construction Documents after the Check Set shall be charged at the hourly rates as noted in Section B: Cost of Services.

All changes outside of the original scope of work resulting in changes to the Design and/or the Construction Documents shall be performed separately and charged at the rates as noted in Section B: Cost of Services.

The Client shall have the right to have the construction documents corrected within a reasonable time frame and within SRDS scheduling time constraints.

Design Services:  Hourly Design Services are available at the rates quoted in Section B: Cost of Services.

 

Drafting Services:  Hourly Drafting Services are available at the rates quoted in Section B: Cost of Services.

 

SECTION B: Cost of Services

Cost of Design and Drafting Services: Custom Home by Builder or Homeowner

For design and drafting services, Fee shall be $1.00 per square foot for drafting of construction documents. Services shall be paid prior to commencement of Services and revised to reflect the final construction documents.

Cost of Hourly Services:

Hourly rates for Services shall also apply to work performed outside the parameters of the Contract for Services.  Hourly rates shall be billed as follows:

Design - $82.00/Hour

Drafting - $70.00/Hour

Additional Cost(s):

FCE spreadsheet - $149.99 each

SECTION C: Terms and Payment for Services

Payment for Services shall be performed by Client and shall not be contingent upon receipt of funds from another source and/or institution.

Payment for custom homes services contract is due when services are contracted.  Hourly services payment is due when services are rendered.  Construction documents for repeat customers with SRD Studio accounts shall not be released until payment in good funds is received by the Service Provider.  The Service Provider, at SRD Studio’s discretion, may release Documents to repeat customers with accounts in good standing while retaining ownership of the plans. Service Provider may charge delinquent accounts reasonable court costs, interest, collection fees and legal fees for collection of Services contract price.

Cost of Services based on square foot of all floor area shall be adjusted to the areas established by the final construction documents and shall adjust the cost of services for a final billing.

Construction documents shall not include Specifications specific information. This Contract shall not include selections of specific colors, makes and models of any material items.

Delivery of the Final Construction Documents shall include revisions based on the Customer review plus any additional design and drafting work requested at an hourly rate, Thereafter Construction Document revisions shall be performed at an hourly rate as described in Section B: Cost of Services.  Acceptance of Check Set Construction Documents shall, after 30 days with no revision requests, indicate acceptance of document content as complete and accurate.

The Service Provider shall, in concert with The Client, establish a reasonable time frame for production of Construction Documents and make every effort to achieve the goal.  The Client shall recognize that the Service Provider, an independent business, has other clients to schedule and must produce work in order to receive payment from any client.  The Service Provider shall make every effort to provide service within a reasonable frame of time.

This comprises the entirety of the agreement.
